Terms of Use.
The rules for using Tessera's website, submitting applications, and engaging with our recruitment services.
These Terms of Use apply to this website and to general interactions with Tessera through the website, forms, email, calendar links, calls, and recruitment workflows. If Tessera signs a separate client agreement, statement of work, placement agreement, data processing agreement, or coaching agreement with you, that signed agreement controls where it conflicts with these Terms.
1. About Tessera
Tessera is a boutique recruitment partner helping European and US companies identify and hire senior LATAM professionals. We work with hiring companies, candidates, partners, and service providers across Europe, the United States, Latin America, and other relevant markets.
You can contact us at hello@tessera.partners.
2. Acceptance of these Terms
By using this website, submitting a form, applying to the talent pool, booking a call, or otherwise interacting with Tessera through this website, you agree to these Terms. If you do not agree, do not use the website or submit information through it.
3. Eligibility
The website and services are intended for adults and professional users. You must be at least 18 years old to submit an application, join the talent pool, or use our recruitment services.
4. Recruitment services
Tessera provides recruitment, search, candidate evaluation, talent pool, and related advisory services. We do not guarantee that any candidate will receive an interview, job offer, visa, work authorization, relocation support, or employment. We do not guarantee that any client will hire a particular candidate or fill a role through Tessera.
Job descriptions, salary bands, benefits, locations, remote-work policies, and hiring timelines may change. We try to keep information accurate, but final hiring terms are set by the hiring company and should be confirmed before accepting any offer.
5. Candidate responsibilities
If you apply, join the talent pool, or communicate with Tessera as a candidate, you agree to:
- provide accurate, current, and complete information;
- only submit materials you have the right to share;
- keep us updated if your availability, location, work authorization, compensation expectations, or role interests change;
- treat client information, interview materials, and salary details shared with you as confidential unless Tessera or the client says otherwise;
- make your own decision about whether a role, client, contract, relocation arrangement, or employment offer is right for you.
Candidates do not pay placement fees for Tessera recruitment services unless a separate paid service, such as a coaching or cohort program, is clearly offered and separately accepted.
6. Client responsibilities
If you interact with Tessera as a hiring company, prospective client, or client representative, you agree to:
- provide accurate role, compensation, location, sponsorship, and hiring-process information;
- comply with applicable employment, contractor, immigration, tax, anti-discrimination, equal opportunity, privacy, and data-protection laws;
- use candidate information only for the role or engagement for which it was shared;
- keep candidate information confidential and restrict access to people involved in the hiring process;
- not contact, hire, or engage introduced candidates outside the agreed Tessera process where a signed client agreement restricts that activity.
Commercial terms, fees, replacement guarantees, ownership of introductions, and payment obligations are governed by the applicable signed client agreement.
7. International hiring and compliance
Tessera works across borders, including Europe, the United States, and Latin America. International hiring can involve employment law, contractor classification, tax, payroll, immigration, benefits, background checks, data transfers, and local labour protections. Tessera may provide practical hiring context, but we do not provide legal, tax, immigration, or financial advice. Clients and candidates are responsible for obtaining advice from qualified professionals where needed.
8. Talent Mobility and paid programs
Tessera may offer optional coaching, cohort, or talent mobility programs. Participation in a paid or unpaid program does not guarantee placement, interview priority, hiring outcomes, visa sponsorship, or client introductions. Any paid program may be subject to additional terms, payment conditions, cancellation rules, or refund policies shown at the time of purchase or enrolment.
9. Privacy and data protection
Our use of personal data is described in our Privacy Policy. By using this website or submitting information, you understand that we may process personal data as described there and in any applicable signed agreement.
Where a signed data processing agreement applies, Tessera and the client will follow that agreement for controller, processor, service-provider, international-transfer, confidentiality, and security obligations.
10. Confidentiality
Recruitment depends on discretion. Unless information is public or independently known, you agree to treat non-public information received through Tessera as confidential. This includes candidate identities, CVs, role details, salary ranges, interview feedback, client hiring plans, shortlist notes, assessment materials, and commercial terms.
11. Website content and intellectual property
The website, text, frameworks, brand elements, methodology language, graphics, and other content are owned by Tessera or used with permission. You may view and share public website pages for normal business purposes, but you may not copy, scrape, reproduce, sell, publish, or create derivative works from our content without permission.
Tessera, the Tessera mark, and related brand elements may not be used in a way that suggests endorsement, partnership, or affiliation without written permission.
12. Acceptable use
You agree not to:
- misuse the website, forms, email addresses, or calendar links;
- submit false, misleading, unlawful, discriminatory, harmful, or infringing content;
- attempt to access systems, data, or accounts without authorization;
- scrape, harvest, or bulk-copy website content or personal data;
- introduce malware, spam, automated abuse, or security attacks;
- use Tessera services to discriminate unlawfully or violate employment, privacy, immigration, or labour laws.
13. Third-party services and links
The website may link to third-party websites or services, including scheduling, form, communication, and other operational tools. Those services are controlled by third parties and may have their own terms and privacy policies. Tessera is not responsible for third-party websites or services that we do not control.
14. No warranties
The website and general website content are provided on an "as is" and "as available" basis. We try to keep the website useful, current, and secure, but we do not promise that it will always be available, error-free, uninterrupted, or free from harmful components.
Nothing on the website is professional legal, tax, immigration, financial, or employment advice. You should obtain qualified advice before making decisions that require professional judgment.
15. Limitation of liability
To the maximum extent permitted by law, Tessera will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost opportunities, lost data, loss of goodwill, or business interruption arising from use of the website or general interactions through it.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where such exclusion is prohibited.
16. Indemnity
You agree to indemnify and hold Tessera harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the website, your breach of these Terms, your unlawful processing or sharing of personal data, or your violation of applicable law or third-party rights.
17. Changes to the website or these Terms
We may update the website, suspend parts of it, or change these Terms from time to time. The latest version will be posted on this page with the updated date. Continued use of the website after changes means you accept the updated Terms.
18. Disputes
If Tessera enters into a signed agreement with you, that agreement may specify the governing law, venue, dispute process, and other legal terms that apply to the relationship. These website Terms do not select a specific court, country, state, or forum. Nothing in these Terms limits rights or protections that cannot be waived under applicable law.
